Jia Mengqi, a PhD student of the University of Macau (UM) Faculty of Law, received the third prize at the First China Legal Talent Awards for Postgraduate Students of Law, for her paper entitled “Study of the Provisional Application Clause in Energy Charter Treaty and Lesson for China: Case Study of the Interim Award of Yukos”, which has been published in the Macau Law Review. FLL Dean Prof. John Shijian Mo comments that this prize not only helps to promote academic exchange among the four Chinese-speaking regions of Taiwan, Macao, Hong Kong and mainland China, but also shows recognition of the research capacity of UM students.

The China Legal Talent Awards for Postgraduate Students of Law was founded by the China University of Political Science and Law (CUPL), with the aim of encouraging studies of legal theories and practice, enhancing law students’ research capacity, and nurturing new talent. The first competition was co-organised by CUPL and the Legal Daily. The competition opens to all full-time postgraduate students of law from universities and research institutions in the four Chinese-speaking regions. This year’s competition received a total of 168 published articles from 36 universities and research institutions in the four regions, among which 6 were from Macao and Taiwan. Through two rounds of selection by 56 experts, 32 articles stood out and received the awards.

Jia Mengqi’s article analyses the importance of provisional application clause in the international treaty-making process, as well as the impact of the Yukos Case on the development of the system of provisional application. It further discusses possible consequences of the shortage of the relevant laws in China, and suggests incorporating the provisional application system in China’s law on treaties.
